We understand that your trust in us is the most important capital of JUSTIFIED BV (hereinafter referred to as “Justified”, “we” or “us”). Your privacy is therefore essential to us. This privacy statement (hereinafter referred to as “Privacy Statement”) applies, among other things, to (i) our website https://justified.be (hereinafter referred to as the “Website”), (ii) visiting our offices and (iii) all (commercial) relationships between Justified and its customers, prospects, and business partners.


This Privacy Statement includes information about the personal data Justified collects and how Justified uses and processes this personal data.


JUSTIFIED emphasizes that it always tries to act in accordance with the EU Regulation 2016/679 of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC.


Visiting the Website, requesting a demo to use Justified's services, creating an account to use Justified's services, subscribing to the newsletter and/or for a seminar, webinar or event implies your explicit approval (by communicating your personal data or opting in) of the Privacy Statement and thus of how we collect, use, and process your personal data.

This Privacy Statement applies to all our potential/current/former users of the Website and the Services of Justified.

Article 2: Who is responsible for processing?

Justified acts as the controller when processing personal data of leads, prospects, and customers.

Personal identification data are processed when a visitor requests a quote; creates an account; enters into a collaboration with Justified; visits the Justified website; visits the Justified offices; downloads templates from Justified; fills in the Justified calculator on the website; uses Justified's services, whether or not through the Website, the Platform and/or the Justified application (hereinafter referred to as the “app”), and whether or not via a mobile device; subscribes to the newsletter and/or blog (whether or not via the Website); verifies their identity (e.g., when contacting customer support); corresponds with and from Justified; shares ideas for improving the services, the Platform and/or the App with Justified; makes a possible link between the Platform and social network platforms.

Grounds for processing the above data


  • You have implicitly or explicitly given consent for the processing of your personal data for one or more specific purposes;
  • The processing is necessary for the performance of the agreement with Justified or to take measures at your request before entering into an agreement;
  • The processing is necessary to comply with a legal obligation that Justified is subject to;
  • The processing is necessary to protect your vital interests or those of another natural person;
  • The processing is necessary for the performance of a task carried out in the public interest;
  • The processing is necessary for the purposes of the legitimate interests pursued by Justified or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms that require the protection of personal data (especially when you are a minor);

  • Conducting prospecting activities regarding Justified's services;

  • Performing an agreement with Justified (including follow-up);

  • Providing Justified's services, whether or not through the Website, the Platform and/or the App, and whether or not via a mobile device;
  • Providing support/assistance (e.g., in case of problems);
  • Sending targeted marketing and advertising, updates, and promotional offers based on your communication preference and, if applicable, based on your explicit approval;
  • Sending invoices and collecting payments;
  • Providing an e-book;

  • Sending newsletter and/or blog;
  • Confirming registration for a webinar, seminar and/or event;
  • Optimizing the quality, management, and content of the Website, Platform and/or App;

Article 4: Google Analytics 

Google Analytics is a web analysis service offered by Google Inc. ("Google"). The Provider uses Google Analytics within the Website, Platform, and/or mobile app. Justified does not pass personal data to Google. By analyzing this data, based on legitimate interest, Justified learns how the website is used and can improve it.

Article 5: Cookies

Cookies are text files placed on your computer to collect standard internet logging information and behavioral information. This information is used to track visitor behavior on the website and to compile statistical reports on website activity.

For example, Justified will automatically log which parts of the Website, Platform, and/or App you visit, which web browser you use, and which website you visited when you gained access to the Website.

Article 6: Who receives my personal data?

Justified receives your personal data. For more information, we refer to the schedule above in Article 3 of this Privacy Statement.


Processors


Justified uses external processors. This means that for certain tasks or studies, we temporarily pass data to third parties if we do not have the resources ourselves, for example, website hosting, mail platform, helpdesk tools, etc. If we do so, we will always ensure that your data is treated confidentially and used securely. Thus, this processor will never use your data on its own initiative and must delete your data as soon as the processor has completed the assignment unless otherwise required by law.

However, without prejudice to the foregoing, Justified may disclose your personal data:


  • To the competent authorities (i) when Justified is obliged to do so by law or in the context of a judicial or future judicial procedure and (ii) to safeguard and defend our rights;
  • In the context of the enforcement by third parties of their intellectual property rights;
  • When Justified or almost all of its assets are acquired by a third party, in which case your personal data – which Justified has collected – will be one of the transferred assets;
  • To detect similar profiles like yours, unless you have explicitly objected to this.


In all other cases, Justified will not sell, rent, or transfer your personal data to third parties unless it has obtained your permission, which includes the necessary guarantees regarding confidentiality and privacy compliance of your personal data.

Article 7: How long are my data kept?

they were collected, as set out in this Privacy Statement. Non-personal information can be retained without limitation in time for statistical purposes.

Individuals have the right to data erasure if retaining the data is no longer necessary in light of the purpose of processing, is unlawful, or if this must be done based on a legal obligation.

Article 8: Security and retention of personal data

Justified acknowledges that the security of personal data is part of data protection. Therefore, Justified takes reasonable physical, technical, and organizational precautions to protect your personal data from unauthorized processing or unauthorized access to prevent misuse.


Justified will store all personal data it has collected in the cloud (with data center(s) within the EU).


Notwithstanding Justified's security policy, the checks it performs, and the actions it takes in this context, an infallible level of security cannot be guaranteed. No method of transmission over the internet or any method of electronic storage is 100% secure, so Justified cannot guarantee absolute security in this context.


Finally, the security of your account will also depend on the confidentiality of your password to access the Platform and/or the App. Justified will never ask for your password, so you are required not to disclose it. If you have shared your password with a third party – for example, because this third party has indicated that it will provide you with additional services – this third party will have access to your account and your personal data via your password. In that case, you are liable for the actions taken using your account. Justified strongly recommends that you change your password immediately if you notice that someone has accessed your account and contact us.

Article 9: How can I exercise my rights? 

You can exercise your rights by sending an email to [email protected]. To prevent any unauthorized disclosure of your personal data, it is required to send the request from the email address linked to your account or contact form submission.


Justified has one month to respond to your request. This period begins when Justified has received your request and has all the necessary information to fulfill your request.


Justified will provide the requested information free of charge. When requests are unfounded or excessive, especially due to their repetitive nature, Justified may charge a reasonable fee or refuse the request.


If for any reason you believe that Justified has not handled your request correctly, you can contact Justified, and we will work with you to find a solution.


If you are dissatisfied with how JUSTIFIED has handled these questions or comments or if you have any complaints about how JUSTIFIED collects, uses, or processes your data, you can file a complaint with the Belgian Data Protection Authority, Drukpersstraat 35, 1000 Brussels, Tel. +32 (0)2 274 48 00, email: [email protected].

Article 10: What rights can I exercise? 

Right of access: You can ask us which personal data we process about you, for what purposes we process it, which categories of personal data we process, with which categories of third parties we share your personal data, what the origin is of the processed data and – when applicable – which logic we use when automatically processing personal data.


Right to rectification: It is currently possible for each user to correct their account data via the Justified Platform. To keep your data up to date, we ask you to make any changes yourself.

Right to erasure: You can ask us to delete your account. This will make it impossible to use the Platform or the App. After the request, Justified will suspend your account for 30 days to give you the necessary reflection time. After that, your account will be permanently deleted.

Right to restriction of processing: In cases determined by Belgian and European privacy legislation. When processing within the Platform is restricted, your personal data (except for storage) will only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of public interest. After obtaining this restriction of processing, Justified will always notify you before lifting the restriction of processing.

Right to data portability: You have the right to receive the personal data you have provided in a commonly used, structured, and machine-readable format, and you have the right to transfer this personal data to another processor or controller where processing is based on the legal grounds of consent or contractual relationship.

Right to withdraw consent: If the processing of personal data is based on consent, you, as a user, have the right to withdraw this consent at any time. This can be done by canceling your account.

Right to object: You have the right to object to the processing of your personal data only if the processing is based on public interest or legitimate interest.

Article 11: Cross-border processing of personal data

Any transfer of personal data outside the European Economic Area (EEA) to a recipient who has their domicile or registered office in a country not covered by an adequacy decision issued by the European Commission will be governed by the provisions of a data transfer agreement, which will (i) include the standard contractual clauses as set out in the ‘European Commission Decision of February 5, 2010 (Decision 2010/87/EC)’ or (ii) any other mechanism under privacy legislation or any other regulation concerning the processing of personal data.

Article 12: Update Privacy Statement

Justified is entitled to update this Privacy Statement by posting a new version on the Website. It is highly recommended to regularly consult the Website and the relevant page on which the Privacy Statement is displayed to ensure that you are aware of any changes.

Article 13: Other websites

The Website may contain hyperlinks to other websites. When you click on one of these links, you may be directed to another website or internet source that may knowingly or through cookies or other technologies collect information about you. Justified has no responsibility, liability, or control over these other websites or internet sources, nor over their collection, use, and distribution of your personal data. You should review the privacy policy of these other websites and internet sources yourself to judge whether they act in accordance with Privacy Legislation.
